Property owners in New York have to prevent trip and falls on their property. If it’s the sidewalk, they should inspect their sidewalk and make repairs as necessary. If within a building, it depends on what you’re tripped on. Let’s say there’s a mat in the foyer and it’s rolled up and old and it’s been there for a very long time, that mat should have been replaced if you trip and fall on that mat. The landlord is negligent under the New York City building codes, uh, the owners have to maintain their property, uh, free of any defects that might cause injury.
