Well, persons with preexisting conditions can still maintain a claim. The conditions are just taken into account as an aggravation of the preexisting condition from the negligent act. So, you might have a prior neck and back injury from years ago from a car accident, but then end up in another car accident, where you, your neck and back do get aggravated, where you have to go for a lot more treatment than, God forbid, even some surgery. So we can claim aggravation of pre-existing injuries.
