New York E-Bike Accident Lawyer

Throughout the already dense and bustling streets of New York, e-bikes have surged in popularity for their efficiency, speed, eco-friendliness, and convenience, particularly among the city’s horde of delivery workers. However, along with their benefits come potential risks, including increased dangers from motorists and pedestrians unused to sharing roads and crosswalks with these motorized vehicles that travel at double the speed of a manually-operated bicycle.

Learn more below about various e-bike dangers and how New York law addresses compensation for e-bike accident victims. If you have been hurt in an e-bike accident in New York City, contact Leandros A. Vrionedes, P.C., for a free consultation with an experienced and dedicated New York e-bike accident lawyer.

New York E-bike Laws

New York State legislation places electric bikes into three categories: Class 1 (Pedal-Assist Bicycles), Class 2 (Throttle Bicycles), and Class 3 (Speed Pedelecs). As per New York’s law, individuals who are 16 years or older are allowed to operate these e-bikes. They are permitted to ride on streets, highways, bridges, and tunnels in New York City, unless posted signs indicate otherwise. However, their operation is prohibited on sidewalks, expressways, or interstate highways. Understanding these laws is the first step towards safe and responsible e-bike usage.

Common E-bike Accident Injuries

E-bike accidents can lead to injuries ranging from minor to severe. Common injuries can include bone fractures, head and brain injuries, spinal cord injuries, road rash, and in severe cases, fatalities. Due to the faster speed of e-bikes, collisions often result in more severe injuries compared to traditional bicycle accidents.

Negligent Drivers and Recoverable Damages

If an e-bike accident occurs due to a negligent driver, victims are entitled to recover damages, which may include medical expenses, loss of earnings, pain and suffering, and more. However, in New York, victims must surpass the “serious injury” threshold to overcome the no-fault law. This requires proof that the injury resulted in death, disfigurement, fracture, loss of a body organ, a significant limitation of a body function or system, or a medically determined injury that prevents the victim from performing typical daily activities for at least 90 days during the 180 days following the accident.

E-bike Battery and Charging Accidents

Beyond collisions, e-bike riders face potential risks associated with the bike’s lithium-ion batteries. These batteries, if faulty, can overheat, leading to fires and explosions. Such accidents can cause burns, respiratory problems, and other serious injuries. According to New York’s Fire Commissioner, over 100 e-bike batteries occurred just in the first half of 2023 alone, taking the lives of 13 individuals and injuring dozens more. Explosive e-bike battery fires can quickly spread to nearby structures, burning very quickly and very hot.

If an accident occurs due to a defective e-bike battery or charger, the manufacturer may be held liable. In such instances, victims could pursue a product liability lawsuit against the manufacturer, arguing that the product was defectively designed, manufactured, or lacked sufficient warnings or instructions. Identifying the party or parties responsible for a battery explosion or charging fire can be a complex yet critical phase of obtaining justice and compensation for innocent e-bike users injured or worse in a fire caused by a defective e-bike battery or charger.
