A lien on a personal injury case can be from Medicare or Medicaid, or sometimes from a private insurance company if it is an ERISA plan. Liens have to be paid back, depending on which one of the above it is, and at a certain percentage or formula that they have.

A lien can be also placed on a case by workers’ compensation coverage. If you’re injured on the job and your medical bills and your time lost from work are paid by a workers’ compensation carrier, they will have an absolute lien on your case under New York State law.
