What if I was in a car accident in New York, and my passenger was injured?

If you are in a car accident and you are not injured but your passenger was, your passenger would be covered under your own insurance company’s no fault benefits. That would cover medical bills and time lost from work. This coverage would fall into place no matter whose fault the accident was, and your passenger would have to meet the no fault serious injury threshold in order to pursue a claim for pain and suffering.
