In a premises liability case, you need to prove notice. There are several types of notice. There’s something called actual notice, where the land owner or manager of the premises has actual notice of a particular defect. Now, what that means is somebody reported to them before, and they have first hand knowledge that it exists.
Also, there’s another type of notice called constructive notice, which means that the land owner or management of the property would have notice of the defect because it’s been there for a certain amount of time that they should have had notice or inspected to look for those kind of defects.
