New York Toxic Exposure Attorney Protecting Construction Workers from Chemical Injuries and Illnesses

Construction workers in New York City face a variety of hazards and dangers on the job, including risks of serious personal injury or wrongful death from toxic exposure. Most accidents and injuries are avoidable, however, and experienced toxic exposure attorney Leandros A. Vrionedes, P.C. holds owners and contractors liable when their failure to provide a safe work environment leads to injuries and illnesses from toxic exposure.

Toxic exposure on the job creates a variety of dangers

Construction workers in New York City risk exposure to an endless stream of toxic materials, including chemicals, solvents, industrial cleansers, paints, varnish, fuel, asphalt fumes, lead and other toxic metals. Exposure to these toxins can result in serious chemical burns, respiratory ailments, nerve damage and paralysis, chronic disease and death. Certain types of work expose employees to specific ailments, such as silicosis from sandblasting or asbestosis or mesothelioma from asbestos exposure during demolition or renovations.

OSHA Guidelines for Chemical Exposure

Standards for working with dangerous materials or preventing or dealing with exposure can be found in Guidelines promulgated by the Occupational Safety and Health Administration (OSHA). OSHA Guidelines for General Industry and Construction in particular provide rules and procedures for dealing with air contaminants, mineral dusts, asbestos, coal tar pitch, bis-Chloromethyl ether, Vinyl chloride, lead, chromium, cadmium, benzene, formaldehyde and bloodborne pathogens, just to name a few.

State law provides protection for workers as well. For instance, the New York Industrial Code provides rules and regulations covering exposure to toxic elements such as exhaust gases from internal combustion engines or lead fumes and dust from structural steel. A violation of the New York Codes, Rules & Regulations (NYCRR) can provide the basis for an action to recover compensation from the owner or contractor under New York Labor Law Section 241(6).
