Civil rights violations are not only illegal; they are unconstitutional. In 1871, Congress enacted 42 U.S.C. section 1983 to give private citizens the right to file a civil lawsuit to stop civil rights violations by the government and people acting under color of law. Today, this law remains as a major force to stop, prevent, remedy and redress governmental abuses.
Civil rights abuses are committed by “state actors,” which includes state officials and government employees, as well as people acting on behalf of the government, often referred to as acting “under color of law.” State actors therefore not only include police officers, prosecutors, judges, prison guards and wardens, but also private security guards hired by the state and public utilities or housing authorities which unfairly discriminate on the basis of race or other illegal factors.
